Appeals of Commission Decisions

An applicant or any interested person may appeal a decision made by the Planning Commission,  Design Review Commission, or Zoning Administrator.   Decisions made by the Community Development Director or designee regarding the rejection, issuance, suspension, modification, or revocation of a cannabis operator permit may also be appealed.  

How to file an appeal 

A Notice of Appeal must be filed within (10) days of the mailing date of the decision notification on the application to the applicant. If the 10th day is on a weekend, the appeal must be filed by 5:00 p.m. on Monday, the first business day following the weekend. If the Monday following the weekend is a holiday, then the appeal must be filed by 5:00 p.m. on Tuesday.

1. Download and completed a Notice of Appeal application.  You may also obtain a Notice of Appeal application by emailing staff at CityClerk@walnut-creek.org or calling 925-943-5818.

2. Submit following documents to the City Clerk within ten (10) days of the mailing date of the decision notification:

    • Completed Notice of Appeal application
    • Required fee
    • Supporting documents

    Filing fees

    The appeal fee is based on the City Council approved fee schedule and are as follows:

    Application type Fee to file appeal 

    An applicant or representative is appealing a decision on their own project and has an open work order account 

    The applicant will be charged a hourly fee of $210.00 for processing.
    An applicant or representative is appealing a decision on a flat-fee application $210.00 (flat fee)
    Appellant is not the applicant of the project
    $210.00 (flat fee)
    Appealing a large family day care decision
    none

    After Filing Notice of Appeal 

    After the filing of the Notice of Appeal, the City Clerk (or other staff liaison, see chart below) will schedule a public hearing before the City Council within a reasonable period of time. Posting and hearing notices for appeals are as outlined in Section 10-2.4.501 of the Municipal Code
