Commercial Linkage and Housing In-Lieu fees are fees on new commercial developments that partially fund affordable housing. The fees are part of the Inclusionary Housing Ordinance.
Commercial Linkage Fee
The Commercial Linkage Fee Ordinance is a fee on new commercial developments that partially funds affordable housing. The current Commercial Linkage Fee is $5 per square foot.

Housing In-Lieu Fee
Municipal Code section 10-2.3.904(C) is a fee that may be paid in-lieu of providing:
- Inclusionary units in an ownership project (other than condominium conversion).
- Inclusionary units in a rental project.
- Inclusionary units in a condominium conversion projects of fewer than seven units.
The developer pays all fees prior to issuance of a building permit for any residential structure in the development project or as determined by the residential development project's adopted conditions of approval.

Residential Nexus Studies
The Residential Nexus Studies assess the demand and cost of affordable housing for the local workforce. The purpose of the studies is to explain the method for determining Commercial Linkage and In-Lieu fees to support affordable housing.
